We take the protection of your data very seriously.Personal data is stored in accordance with statutory requirements and in particular the GDPR and the German Data Protection Act (BDSG). Please take the time to read our privacy policy.

§ 1 Collection of personal data

  1. We inform you about the collection of personal data when you use our website. Personal data is information which can be related to you personally and with which you are therefore identified or made identifiable. It includes for example your name, address and e-mail addresses, as well as your user behaviour.

  2. The controller within the meaning of Art. 4 Para. 7 of the EU General Data Protection Regulation (GDPR) is specOculus GmbH, Zollstr. 11, 39114 Magdeburg (info@specoculus.com). This data is also available in our impressum, a link to which can be found on our website at https://specoculus.com. We are not under obligation to appoint a Data Protection Officer.Nevertheless, if you have any questions concerning data protection, you can contact us at the e-mail address datenschutz@specoculus.com. You can also write to us at the address provided in the impressum.

  3. If you contact us by e-mail or via a contact form provided on our website, the data you provide us (your e-mail address, if applicable your name and telephone number) will be stored by us so that we can reply to your questions. We will erase the data collected in this connection when it no longer needs to be stored or restrict the processing if there are statutory retention obligations.
  4. If we use contracted service providers for individual functions of our service or would like to use your data for promotional purposes, we will inform you in detail of the respective processes. We will also state the defined criteria for storage period.

§ 2 Your rights as the data subject

You have the right:

  • pursuant to Art. 15 GDPR to ask for information about the data processed by us concerning yourself.In particular you can ask for information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to correction, erasure, restriction of processing or objection, the existence of a right to complain, the origin of your data, if this was not collected by us, and about the existence of automated decision-making including profiling and if applicable meaningful information about its details;
  • pursuant to Art. 16 GDPR to ask for the immediate rectification of inaccurate or immediate completion of incomplete personal data stored by us;
  • pursuant to Art. 17 GDPR to ask for the erasure of your data stored by us, unless the processing is necessary to exercise the right of freedom of expression and information, to meet a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • pursuant to Art. 18 GDPR to ask for the restriction of the processing of your personal data, if the accuracy of the personal data is contested by you, the processing is unlawful and you oppose its erasure and we no longer need the data, but it is required to assert, exercise or defend legal claims or you have objected to the processing pursuant to Article 21 GDPR;
  • pursuant to Art. 20 GDPR to ask to receive your personal data which you have provided us in a structured, commonly used and machine-readable format or transmit it to another controller;
  • pursuant to Art. 7 Para. 3 GDPR to withdraw your consent from us at any time. As a result of this, we will in future no longer be allowed to continue the data processing based on this consent and
  • pursuant to Art. 77 GDPR to lodge a complaint with a supervisory authority. As a rule you can contact for this purpose the supervisory authority for your habitual residence, place of work or our headquarters.   • If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 Para. 1 Clause 1 Letter f GDPR, you have the right, pursuant to Art. 21 GDPR, to object to the processing of your personal data if there are grounds relating to your particular situation or you object to direct marketing. In the latter case you have a general right to object which will be acted upon by us without you needing to state grounds relating to your particular situation. If you would like to exercise your right to withdraw your consent or object, you need only send an e-mail to datenschutz@specoculus.com or a short letter.

§ 3 Collection of personal data when you visit our website

  1. If you use the website purely for information purposes, i.e. if you do not register or provide us with any other information to use the website, we do not collect the personal data which your browser sends to our server. If you would like to view our website, we collect the following data required by us for technical reasons in order display our website to you and to ensure stability and security (legal basis is provided by Art. 6 Para. 1 Clause. 1 Letter f GDPR):

         ● Content of the request (specific page)
         ● Access status/HTTP status code
         ● Data volume transmitted
         ● Website from which the request comes
         ● Browser used including language and version
         ● Operating system used, surface and resolution
  2. In addition to the aforementioned data, when you use our website, cookies will be stored on your computer. Cookies are small text files which are stored on your hard drive, are allocated to the browser used by you and through which certain information is sent to the body which places the cookie (here by us). Cookies cannot execute any programmes or transmit viruses to your computer.They serve to make the website on the whole more user friendly and more effective.
  3. Use of cookies:
    1. This website uses the following types of cookies, and we explain below the degree to which and how they are used:
      • Transient cookies (b)
      • Persistent cookies (c) 
    2. Transient cookies are deleted automatically when you close the browser. These include in particular the session cookies. These store a so-called session ID, with which various requests by your browser can be assigned to the shared session. As a result, your computer can be recognised when you return to the website. Session cookies are deleted when you log out or close your browser.
    3. Persistent cookies are automatically deleted after a predetermined time, which can vary depending on the cookie. You can delete these cookies any time in the security settings of your browser.
    4. You can configure your browser settings as you wish and for example refuse the acceptance of third-party or all cookies. Please note that in this case you may not be able to use all the functions of this website.
    5. We also use cookies in order to be able to identify you when you visit the website again, if you have an account with us. Otherwise you would have to log in again every time you visit.
    6. Flash cookies used are not recorded by your browser, but by your Flash plugin. We also use HTML5 storage objects, which are stored on your device. These objects store the necessary data regardless of the browser you are using and have no automatic expiration date. If you do not wish Flash cookies to be processed, you have to install an appropriate add-on, for example “Better Privacy” for Mozilla Firefox or the Adobe Flash killer cookie for Google Chrome. You can prevent the use of HTML5 storage objects by setting the private mode in your browser. We also recommend that you regularly delete your cookies and the browser history manually.

§ 4 Disclosure of data

We only disclose personal data to third parties if:

  • you have given your explicit consent pursuant to Art. 6 Para. 1 Clause 1 Letter a GDPR,
  • the disclosure is necessary pursuant to Art. 6 Para. 1 Clause 1 Letter f GDPR to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data.
  • there is a statutory obligation to disclose pursuant to Art. 6 Para. 1 Clause 1 Letter c GDPR, and
  • this is permitted by law and necessary pursuant to Art. 6 Para. 1 Clause 1 Letter b GDPR for the processing of contractual relationships with you.

§ 5 Data security

We use the widespread SSL process (Secure Socket Layer) for our website. This is used with the highest encryption level supported by your browser. We also use suitable technical and organisational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are improved continuously in line with technological developments.

§ 6 Newsletter

  1. With your consent, you can subscribe to our newsletter, with which we will inform you about our latest interesting offers. The goods and services advertised are stated in the declaration of consent.
  2. For the registration for our newsletter we use the double-opt-in process. This means that after you have registered, we will send you an e-mail to the e-mail address specified in which we will ask you to confirm that you would like to be sent the newsletter. If you do not confirm your registration within 72 hours, your information will be blocked and deleted automatically after one month. We also store your IP addresses used and the times of registration and confirmation. The purpose of the process is to verify your registration and to clear up any possible misuse of your personal data.
  3. The only information required for the newsletter to be sent is your e-mail address. The disclosure of other data marked separately is voluntary and will be used to address you personally. After your confirmation, we will store your e-mail address for the purpose of sending the newsletter. The legal basis is provided by Art. 6 Para. 1 Clause 1 Letter a GDPR.
  4. You can withdraw your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the withdrawal by clicking on the link provided in every newsletter e-mail, via a form on the associated website, by sending an e-mail to newsletterverwaltung@specoculus.com or by sending a message to the contact details provided in the imprint.
  5. We point out that we analyse your user behaviour when we send the newsletter. For this analysis, the e-mails sent include so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the analyses, we link the data stated in para. 3 and the web beacons with your e-mail address and an individual ID. Links received in the newsletter also contain this ID.Using the data obtained in this way we create a user profile in order to tailor the newsletter to your individual interests. This allows us to record when you read our newsletter, what links you click on in the newsletter and to deduce your personal interests from this. We link this data to actions performed by you on our website.
  6. You can object to this tracking at any time by clicking on the special link provided in every e-mail or by informing us through another means of contact. This information will be stored for as long as you are subscribed to the newsletter. After you unsubscribe, we store the data purely statistically and anonymously. Furthermore, such tracking is not possible if you have disabled the displaying of images by default in your e-mail programme. In this case you will not see the full newsletter and you may not be able to use all the functions. If you allow the images to be displayed manually, the above-mentioned tracking takes place.
